PickProof Terms of Use

These Terms are an agreement between you and PickProof, LLC, a Louisiana limited liability company ("PickProof," "we," "us"), and govern your use of PickProof, including the web app, mobile apps, API-backed features, alerts, records, leaderboards, badges, and related services.

By creating an account, confirming a pick, purchasing a subscription, using the app, or accessing PickProof, you agree to these Terms. If you do not agree, do not use PickProof.

1. What PickProof Is

PickProof is an informational sports pick-tracking ledger and analytics tool. PickProof tracks picks, records, odds, scores, and verification receipts. PickProof helps users confirm picks for recordkeeping, track unit-based performance, compare public records, follow other users, receive alerts, and review historical pick activity.

PickProof is not a sportsbook, casino, lottery, daily fantasy operator, exchange, brokerage, wagering platform, funds-transfer app, or gambling operator.

PickProof does not recommend that you place a wager, does not route you to place a wager, and does not provide financial, gambling, investment, legal, tax, or professional advice.

PickProof is not affiliated with, sponsored by, endorsed by, or officially connected to any sportsbook, league, team, event organizer, app marketplace, payment processor, or data provider unless PickProof expressly states otherwise in writing.

2. No Wagers, Deposits, Payouts, or Betting Credits

You cannot use PickProof to:

Unit sizes, risk amounts, to-win amounts, profit/loss, ROI, CLV, and records are informational recordkeeping fields only. They do not represent money held, owed, paid, or transferred by PickProof.

PickProof does not determine whether you are legally permitted to gamble or use third-party sportsbooks outside PickProof. Any activity you choose to take outside PickProof is solely your responsibility.

PickProof does not provide sportsbook account creation, sportsbook login, sportsbook links for wagering, sportsbook deposits, sportsbook withdrawals, sportsbook bonuses, sportsbook promo codes, or sportsbook customer support.

3. Confirmed Pick Integrity

When you confirm a pick, it becomes a Confirmed Pick. Confirmed Picks are locked for data integrity.

After confirmation, you cannot edit or delete:

Results may be updated only through automated grading, source correction, or an audit process controlled by PickProof.

Verified Pick Receipts and QR verification pages are record-integrity tools. The API verification record is the authoritative PickProof record; screenshots, shared images, posts, cropped images, or copied text can be altered outside PickProof and should not be treated as authoritative without scanning the QR code or checking the verification link.

Terms such as "Verified" and "Receipt" describe PickProof's internal record-integrity checks only. They do not mean legal certification, notarization, endorsement, or financial guarantee.

4. Odds, Scores, and Data

Odds, scores, rotations, game status, line movement, closing-line value, and grading data are provided for informational purposes only. Data may be delayed, missing, suspended, stale, corrected, inaccurate, or unavailable.

You are responsible for independently verifying any information before using it outside PickProof. Odds are informational and may change quickly. PickProof is not responsible for decisions made based on odds, scores, picks, alerts, records, or analytics.

Sportsbooks may suspend, move, remove, or correct lines at any time. PickProof may show a last observed pregame line, an `OFF` state, or a corrected grade when data sources change.

PickProof may remove, delay, suppress, correct, or relabel odds, scores, rotations, logos, images, line movement, CLV, grades, public records, leaderboards, or receipts if PickProof believes the data is inaccurate, stale, disputed, unavailable, legally risky, or technically unreliable.

5. Alerts

Alerts may include favorite team updates, followed-user public picks, game status, line movement, CLV, and grading events. Alerts are best-effort. Delivery depends on device permissions, network access, Apple/Google/Expo delivery, backend availability, and data-source freshness.

PickProof does not guarantee that alerts will arrive, arrive on time, or contain final/correct information.

Alerts are not instructions to act. Users must not rely on alerts as a substitute for independent verification.

6. Subscriptions

PickProof Pro unlocks software features such as privacy controls, delayed public reveal, Pro Picks access, advanced filters, followed-user alerts, and an ad-free experience.

A PickProof subscription does not buy betting credits, wagering access, contest entry, a chance to win money, sportsbook access, or any financial product.

Subscription billing, cancellation, renewal, and refunds are handled by the applicable payment provider or app store according to their terms.

Subscription prices, features, and availability may change. If subscriptions are sold through Apple App Store or Google Play, their billing, cancellation, refund, and restore-purchase rules apply.

PickProof may refuse, cancel, refund, or disable a subscription if required by law, platform rules, payment processor rules, fraud controls, or these Terms.

7. Public and Private Picks

Free users can create public picks only. Pro users may create private or delayed-public picks where enabled.

Pick visibility must be selected before confirmation and cannot be changed afterward. You may not hide losing public picks after confirmation or selectively make only winning picks public.

Private picks are excluded from public feeds and public leaderboards unless a future feature and policy explicitly states otherwise.

PickProof may display a user's public records, public ranks, public badges, public receipts, and public picks for accountability. Public records are informational and are not endorsements, certifications of profitability, betting advice, or guarantees of future performance.

8. Public Content and Profiles

Public usernames, avatars, badges, public records, public picks, and leaderboard rows may be visible to other users. Do not upload unlawful, abusive, misleading, infringing, or personally sensitive content.

PickProof may review, remove, blur, replace, disable, or restrict avatars, images, usernames, badge displays, public picks, or other content if that content violates these Terms or creates legal, safety, integrity, or platform risk.

You may report a public user from that user's profile and block another user using the in-app controls. Blocking removes follows between the accounts and filters the blocked account and its public picks from your public views. PickProof reviews reports and may restrict content or accounts.

By uploading or entering content, including usernames, avatars, images, badge choices, profile text, or public pick comments if enabled, you grant PickProof a non-exclusive, worldwide, royalty-free license to host, copy, display, resize, cache, transmit, and use that content to operate and promote PickProof. You represent that you have the rights needed to provide that content.

9. Age and Lawful Use

PickProof is intended for adults who may lawfully use sports-information and analytics tools in their location. You are responsible for complying with laws that apply to you.

If you choose to gamble outside PickProof, you are solely responsible for following applicable laws and using independent responsible-gaming resources. PickProof does not provide responsible-gaming services, self-exclusion services, sportsbook account controls, or gambling treatment resources.

You must be at least 18 years old and the age of majority in your location to use PickProof. If your location requires a higher age for sports-information, analytics, subscriptions, or related content, you represent that you meet that higher age requirement.

10. Contests and Promotions

No cash-prize contest, paid contest, sweepstakes, or promotion is active unless PickProof publishes separate official rules. Apple, Google, and app marketplaces are not sponsors of PickProof promotions.

Unless separate official rules state otherwise, badges, ranks, leaderboards, streaks, receipts, and public records have no cash value and do not create a right to prizes, compensation, or payouts.

PickProof may offer free badges, ranks, leaderboards, or non-cash recognition. These features are for engagement and recordkeeping only. They are not gambling, sweepstakes, contests with prizes, fantasy sports contests, lotteries, or games of chance.

11. Intellectual Property

PickProof owns or licenses the app, code, design, branding, and original content. Team, league, sportsbook, fighter, event, and media names, logos, images, statistics, odds, schedules, and marks belong to their respective owners and may be used only for identification, informational display, nominative reference, or other legally permitted purposes.

If you believe content infringes your rights, contact support with enough detail to identify the content and rights at issue.

PickProof may remove, replace, cache-bust, or disable third-party marks, logos, images, odds, scores, schedules, or other data if a rights owner objects or if legal, platform, technical, or source-access risk changes.

Notices about intellectual property, data rights, or takedown requests should be sent to the contact address below and include the requester name, rights owner, content location, claimed right, and contact information. PickProof may remove disputed content while reviewing a request.

You are responsible for keeping your login credentials secure. Notify PickProof if you believe your account has been accessed without permission.

14. Account Deletion

You may permanently delete your account through PickProof account controls after password confirmation, or contact support if you cannot access your account. Account deletion removes the associated profile, picks, follows, settings, push tokens, and public account data. Limited provider transaction, security, tax, legal, abuse-report, and backup records may be retained where legally required or reasonably necessary, with account identifiers removed where appropriate.

15. Suspension and Termination

PickProof may suspend, restrict, or terminate access to any account or feature if PickProof believes the user violated these Terms, created legal or platform risk, harmed record integrity, abused the system, infringed rights, or threatened app reliability.

PickProof may modify, pause, discontinue, or remove features, data sources, sports, markets, sportsbooks, badges, leaderboards, subscriptions, alerts, receipts, or public feeds at any time.

16. Disclaimers

PickProof is provided as-is and as-available. PickProof disclaims warranties of accuracy, uninterrupted availability, fitness for a particular purpose, non-infringement, profitability, prediction quality, ranking accuracy, and data-source completeness to the fullest extent permitted by law.

No PickProof record, badge, rank, leaderboard position, receipt, CLV value, ROI value, win percentage, line movement, alert, or public feed item should be interpreted as professional advice, a guarantee, or a recommendation to take action outside PickProof.

17. Limitation of Liability

To the fullest extent permitted by law, PickProof is not liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, including losses allegedly arising from odds, scores, alerts, grading, records, public picks, or decisions made outside PickProof.

To the fullest extent permitted by law, PickProof's total liability for all claims relating to the service will not exceed the greater of: (a) the amount you paid PickProof for the service in the three months before the claim arose, or (b) $100.

18. Release

To the fullest extent permitted by law, you release PickProof from claims, demands, losses, liabilities, and damages arising from third-party sportsbooks, third-party data sources, app stores, payment processors, push notification providers, hosting providers, other users, public content, public records, public receipts, or decisions you make outside PickProof.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless PickProof and its owners, operators, contractors, service providers, and affiliates from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your use of PickProof, your content, your violation of these Terms, your violation of law, your infringement of rights, or your decisions/actions outside PickProof.

20. Dispute Resolution, Arbitration, and Class Action Waiver

This section should be reviewed by qualified counsel before public launch. To the fullest extent permitted by law, you and PickProof agree to first try to resolve disputes informally by contacting the support/legal email below.

If a dispute is not resolved informally, you and PickProof agree that disputes will be resolved by binding individual arbitration rather than in court, except for small-claims matters, intellectual-property enforcement, or claims that cannot be arbitrated by law. You and PickProof waive the right to a jury trial and waive the right to participate in a class action, class arbitration, representative action, or consolidated proceeding to the fullest extent permitted by law.

If any part of this dispute-resolution section is found unenforceable, the rest of these Terms remain in effect to the fullest extent permitted by law.

21. Governing Law

These Terms are governed by the laws applicable to PickProof's principal place of business, without regard to conflict-of-law rules, except where local law requires otherwise. Courts or arbitrators must apply mandatory consumer protections where required by law.

22. Severability, Assignment, and Survival

If any part of these Terms is unenforceable, the remaining parts remain in effect. PickProof may assign these Terms in connection with a merger, acquisition, financing, reorganization, asset sale, or transfer of the service. Sections concerning Confirmed Pick integrity, public records, intellectual property, disclaimers, limitation of liability, release, indemnification, dispute resolution, and data retention survive termination.

23. Changes

PickProof may update these Terms as the product changes. Continued use after an update means you accept the updated Terms.

20. Reporting Content, Blocking Users, and Moderation

PickProof includes public usernames, avatars, badges, public records, public picks, follows, leaderboard rows, and verified receipt links. These are user-generated or user-selected surfaces and must stay appropriate for a sports recordkeeping community.

Do not upload, display, or submit content that is unlawful, threatening, harassing, hateful, sexually explicit, exploitative, privacy-invasive, infringing, misleading, impersonating another person, encouraging self-harm, encouraging illegal activity, or designed to manipulate PickProof records or other users.

Users may report objectionable content, a username, avatar, public pick, public profile, or other public item by using in-app reporting controls where available or by emailing [email protected] with the username, content location, screenshot if available, and reason for the report. Users may also request that PickProof block or restrict another user from interacting with them where blocking tools are available or by contacting support.

PickProof may review, hide, remove, blur, replace, restrict, suspend, or terminate content or accounts when we believe content violates these Terms, creates legal or platform risk, harms users, infringes rights, misleads users, or undermines record integrity. Moderation decisions may be made with automated tools, manual review, or both.
